Attorney John Yasi, who is representing the four plaintiffs, alleges his clients were concerned over the private information contained in the hospital billing records that were accidentally left on a rapid transit railway car by a hospital manager, The Boston Globe said Thursday.
"The damages that jump out are the emotional distress surrounding the loss of obviously very sensitive medical information and, secondarily, the loss of personal security information," Yasi alleged. "A Social Security number in reality may lead to identity theft, which we all know is a nightmare."
The hospital informed 66 of its patients their billing records were lost March 9 on the Massachusetts Bay Transportation Authority rail system by an unidentified manager, the Globe said.
While four of the patients are currently involved in the lawsuit against the hospital, Yasi has filed a motion in the legal case to gain civil action status to represent all 66 impacted patients. The financial compensation being sought in the suit was not reported.
