Judge John Cunningham said the hearing will determine whether there is enough evidence to bring Brian Stewart to trial on a charge of first- degree assault. Stewart, 31, was arrested April 21 and charged with allegedly injecting his then-11-month old son with a syringe of HIV-infected blood in 1992 to avoid paying child support. The child was being treated for respiratory problems at St. Joseph Hospital-West in Lake St. Louis, Mo., at the time.
Stewart, a medical worker from Columbia, Ill., worked as a phlebotomist - a person who draws blood - at Barnes Hospital in St. Louis.
The boy, now 7, was diagnosed with full-blown AIDS in 1996.
A blood test performed last July confirmed Stewart was the boy's father and he was ordered to pay $292 a month child support.
