In a letter sent through its attorneys to Mbeki's office on Friday, the TAC said Tshabalala-Msimang had failed in her constitutional duty to ensure the protection of human rights, including the progressive realisation of the right of access to health care.
The letter was a response to Mbeki's call to provide evidence that his health minister was guilty of dereliction of duty.
Heather Mangwiro, the attorney acting on behalf of the TAC, also accused the health minister of failing in her duties of "accountability, transparency and responsive governance".
In a letter sent to Mbeki in September last year, the TAC outlined the record number of children's deaths and the "dramatic and continual" increase in HIV/Aids-related deaths.
The TAC asked Mbeki's office to respond to its demand by September 7, otherwise it would approach the courts for relief.
