Solicitor General Grilled Over GF Cash

The commission of inquiry into the alleged mismanagement of the Global Fund yesterday grilled Lucien Tibaruha, the solicitor general, for receiving sh60m for the justice ministry, banking it and not spending it on HIV/AIDS activities.

The commission heard that the ministry got the money in April from the Project Management Unit.

Tibaruha is the accounting officer for the ministry.

The money was intended for training of staff in HIV/AIDS, counselling, developing sector-wide policy and guidelines on HIV/AIDS. The ministry also got sh21m from the Aids Control Programme and kept it, plus that from that Global Fund, in a Bank of Uganda account.

The priceWaterhouse-Coopers report, which led to the suspension of the fund, queried the ministry for not using the money.

Justice James Ogoola, commission chief, said Tibaruha and the ministry were at risk of being accused of negligence.

"Were you incapacitated to do the work? You received the money and it sits there. Isn't it negligence, neglect of duty? You are at risk of being accused," Ogoola said.

He said even if Tibaruha was busy with the political transition, the HIV/AIDS problem was worse. "You talk of transition. HIV is worse than transition. People are dying. If you had not taken the money, someone would have put it to good use," he said.

Tibaruha said the process of looking for money for HIV activities started in 2003 but it was availed in July.

He said the ministry had opened an account with the dfcu but last year, the government directed that all accounts of government departments be kept at Bank of Uganda.
