FDA Statement on RX Depot Decision

Food and Drug Administration (FDA) - November 6, 2003


This ruling sends a clear signal that those who would put profit before safety will not be allowed to threaten the public health. After reviewing the facts, Judge Eagan found that Rx Depot "violates the law and that the safety, purity, and efficacy of drug products obtained through the defendants cannot be assured."

Congress needs to take effective action to provide access to safe and affordable drugs for all Americans through actions like a Medicare prescription drug benefit and new laws to improve access to inexpensive generic drugs -- laws that are pending in front of Congress right now.

FDA is continuing to uphold its longstanding obligation under the law that Congress has given us -- to protect Americans from illegal drugs that may be unsafe, ineffective, poorly made, substandard or counterfeit.
