HIV case student faces probation charge

SOUTH DAKOTA -- Within hours of receiving probation for a felony conviction of having sex without telling his girlfriend he had the AIDS virus, a college student from Chicago violated the terms of his release from jail, South Dakota prosecutors said Wednesday.

Nikko Briteramos, 19, was released a few hours after sentencing Aug. 29 so he could register for classes. He was ordered to return to Beadle County Jail as soon as he completed registration. The jail is five blocks from the campus of Si Tanka-Huron University in rural South Dakota.

Instead, he returned more than five hours later, said Beadle County State's Atty. Michael Moore.

Briteramos then failed a drug test for marijuana, Moore said. Briteramos is now scheduled for a Sept. 17 hearing on revocation of probation. In the court appearance Aug. 29, Circuit Judge Tim Tucker gave the teen a 5-year prison sentence, then immediately suspended it to 120 days in the Beadle County Jail and 200 hours of community service.
