HIV man raped counsellor

BBC News - Tuesday, 2 December, 2003

A man with HIV has been jailed for 10 years for raping an Aids counsellor.

Linkoy Muhuri, 34, of Ranelagh Road, Tottenham, north London, had claimed the woman encouraged him to have sex with her.

She endured months of uncertainty before test results showed she had not been infected with the virus.

Judge Richard Hawkins rejected a call for leniency because of his condition saying: "I have to consider... the risk you represent to women."

"You are an HIV sufferer and you committed rape knowing that and without using a condom."

The judge also recommended Muhuri be deported to the Congo on his release.

Muhuri's lawyer said there would be no medical treatment available for him in the Congo.

But Judge Richard Hawkins said: "You could say it applies to anyone (with HIV) who is convicted of an offence."

He added that medical treatment in jail was a matter for the prison authorities and the Home Office.

The Old Bailey trial heard that Muhuri and his victim chatted for two hours about HIV and Aids at her home before he attacked her.

She told the jury: "He was like an animal. I could not believe he would do this to me after what we had been talking about."

Muhuri arrived in the UK in 1999 but his application for political asylum was rejected and he was due to be deported.

But his lawyers had applied for him to remain on compassionate grounds.
