Mich. man to face trial for biting neighbor's face

CLINTON TOWNSHIP, Mich. - A Detroit-area man who prosecutors say tried to use HIV as a weapon when he bit through his neighbor's lip will stand trial.

Forty-four-year-old Daniel Allen of Clinton Township faces charges of assault with intent to maim, assault with intent to commit great bodily harm and possession or use of a harmful device.

The Detroit News reports Allen was bound over Monday to stand trial in Macomb County Circuit Court, where he will appear Nov. 16.

Winfred Fernandis Jr. says he confronted Allen Oct. 18 over a football children had tossed into Allen's yard. Fernandis says Allen bit him in the face.

Allen says he is HIV positive.

Defense attorney James Galen Jr. says Allen was attacked by Fernandis and his family members because Allen is gay.
