Vasily Aleksanian suffers from full-blown AIDS, tuberculosis and near total blindness and his lawyers last week denounced his $1.8 million bail as too high.
His trial was suspended earlier this year and Aleksanian was moved to a clinic in February while lawyers demanded his released on health grounds.
"The applicant's detention on remand should be discontinued," the Chamber said this week. Russia can still appeal the case and have it referred to the court's Grand Chamber.
A final ruling against Russia would require the country to release him; any refusal could be referred to the Council of Europe, where Russia would face possible sanctions.
Yukos, once Russia's largest oil producer, was broken up and sold off in auctions ordered by the state. Criminal cases against jailed Yukos founder Mikhail Khodorkovsky and his executives are widely regarded as Kremlin revenge for Khodorkovsky's political ambitions.
Aleksanian had been a vice president at Yukos and a lawyer for Khodorkovsky, who is serving an eight-year sentence in a Siberian prison on fraud and tax evasion charges.
