Ohio man on trial, accused of hiding HIV diagnosis

Associated Press - November 14, 2008

DELAWARE, Ohio - A trial has opened for a central Ohio man accused of not telling a girlfriend he has the virus that causes AIDS.

Forty-five-year-old Peter Ayala was charged in June with one count of felonious assault under a state law making it a felony for a person who tested positive for HIV to conceal it from a sexual partner.

The former Delaware County resident was on the witness stand Thursday and denied hiding his diagnosis from the woman in question.

But a former victim's advocate testified that the woman was unaware Ayala was HIV-positive. A Delaware police detective told the jury that Ayala disclosed his status in a separate criminal case and said he had not told anyone but his mother.

Ayala responded that he had misspoken at that time.
