A California judge has ruled that the Franklin Mint may go ahead with a $25 million malicious prosecution lawsuit against the Diana, Princess of Wales Memorial Fund, an official of the collectibles company said Saturday. The trial is scheduled to begin Nov. 5 in Superior Court in Los Angeles, said Howard Lucker, vice president and general counsel for the Franklin Mint, which is based near Philadelphia.
The Franklin Mint and the fund have been battling in court since the fund and executors of Diana's estate accused the company of unlawfully using her likeness when it marketed a Diana "Limited Edition Commemorative Plate."
That lawsuit was thrown out, and the Franklin Mint filed the $25 million lawsuit in November 2002 accusing the fund and Diana's estate of acting maliciously in filing it.
The memorial fund was established to channel $34 million donated after Diana's death in a 1997 Paris car crash to her favorite projects, including helping those with AIDS , the homeless and land mine victims.
The Franklin Mint has said it will donate any money it won in the lawsuit to charities whose causes Diana had championed.
