Caprow drew national attention in February when he claimed the firm of Frank & Freedus in San Diego didn't want to pay for his health insurance. The company denied his allegations.
Unlike the Tom Hanks character in Philadelphia, Caprow lost his claim. A judge agreed in March with the defense that Caprow was a victim of a poor economy, not discrimination.
Caprow was laid off in April 1992, weeks after he confided to an office manager that he had HIV. He also had filled out a company health form that included a question about AIDS.
Eric Freedus, a part-owner of the firm, testified the decision to fire Caprow was made before the health surveys were filled out. He said business was bad and Caprow wasn't performing up to expectations. Partners didn't learn until months later that Caprow was infected, Freedus said.
Caprow was a volunteer at the San Diego AIDS Foundation.
