In a unanimous decision, the Appellate Division of the State Supreme Court upheld State Correction Commissioner Thomas A. Coughlin 3d's policy to deny participation of inmates in the "Family Reunion Program" if they are diagnosed as having a communicable disease.
The reunion program gives selected inmates and their families the chance to meet for an extended amount of time in privacy.
The inmate, called John Doe by the court to protect his identity, is serving a prison sentence of 5 1/2 to 11 years.
