Without the council's vote on Friday, the emergency regulation, which prohibits any establishment from allowing anal intercourse or fellatio on its premises, would have expired Tuesday.
The regulation still faces a court challenge brought by the Coalition for Lesbian and Gay Rights, which contends it is unconstitutional. The regulation has resulted in the padlocking of the Mine Shaft, a bar catering to homosexuals, and the New St. Mark's, a bathhouse catering to homosexuals, and the voluntary closing of some other establishments.
Homosexual groups were sharply critical of the council's action. The co-director of the National Gay and Lesbian Task Force, Rosemary Kuropat, expressed concern that the law establishes "dangerous precedent in favor of the reinstitution of sodomy statutes and other violations of the constitutionally guaranteed rights to privacy."
The council did not amend the regulation, but did change an accompanying resolution to emphasize that intravenous drug use is also a major means of spreading acquired immune deficiency syndrome, and to note education is necessary to fight the spread of the disease.
