"Hopkins Hospital Replies to AIDS Suit"

Abstract: In its first response to a lawsuit filed Monday in Baltimore Circuit Court and in the Maryland Health Claims Arbitration Office, Johns Hopkins Hospital said it had no legal obligation to inform patients of Rudolph Almaraz that the surgeon had AIDS. The hospital's attorney, Paul Rosenberg, said the law did not mandate disclosure of the surgeon's illness and that laws prohibit HIV testing of employees without informed consent. Perry and Dennis Rossi, who filed the suit, said the hospital knew or should have known Almaraz had AIDS and should have informed his patients or barred him from operating. The Rossis filed suit for $32 million in damages from the hospital and the Almaraz estate.
