"Disclosure Ordered in AIDS Case"

Abstract: Carson City--A Reno blood bank must partially disclose information on a donor whose blood transmitted HIV to a Bishop, Calif., man, the Nevada Supreme Court ruled Wednesday. United Blood Services (UBS) had argued that disclosure could curtail blood donations and lead to further requests for information and lawsuits. Jeffrey Clark, who received the contaminated blood after a hunting accident in 1985, discovered he had AIDS in 1988. Clark's attorney, Robert Herman, won a Washoe County District Court order to receive a telephone deposition from the donor or get his name if the blood bank could not locate the man. Herman said he wanted to interview the man to ensure UBS had followed proper screening procedures to identify possible HIV carriers. The Supreme Court modified the earlier order and told UBS to try to locate the donor and set up a telephone disposition. The disposition must not have any questions that could reveal the donor's identity. If the donor is dead, the court said, Clark could have access to the man's medical records with his name removed from them.
