"Mattox Rules AIDS Disclosure Law in Housing Illegal"

Abstract: Austin, Texas--State Attorney General Jim Mattox ruled that a new law requiring Texas real estate agents to disclose, if asked, whether previous occupants of a dwelling had contracted HIV is illegal. Mattox said the law violates the 1988 Federal Fair Housing Act outlawing discrimination against the handicapped. Sponsors intended the law to protect sellers who remained silent on the subject, but added the disclosure provision to soothe factions who saw the issue as one of gay rights.
