"Va. Judge Throws Out Suit by AIDS Clinic"

A landlord acted legally in canceling a lease with Washington, D.C.'s Whitman-Walker Clinic, an Arlington, Va., judge ruled yesterday. In rejecting the clinic's suit against C.J. Coakley Co., Circuit Court Judge Thomas R. Monroe ruled the company could cancel the lease on the Falls Church office becAUse the clinic did not pay its first-month rent on time and failed to provide $2 million in property insurance as stipulated. The clinic planned to use the offices for AIDS counseling, education, and support services conducted by Project NOVA, its northern Virginia branch. The clinic's lawyers admit the rent was one day late, but argued for a grace period. Leasing agent Maria Coakley David testified that Project Nova Director PAUl Wirhun never mentioned AIDS until Dec. 1, a day before she terminated the lease--a claim Wirhun disputes--but says that did not affect her decision. David claimed, "This is not an AIDS issue." Clinic attorney Kenneth E. Labowitz suggested the landlord's real motivation for the termination was the "sudden realization of who these people were."
