If history holds, nearly all the prisoners who have applied to New York Gov. Mario Cuomo for clemency will be disappointed, says William J. Rold, staff attorney for the Prisoners' Rights Project of the Legal Aid Society in New York. Cuomo has never granted clemency to anyone with AIDS, although inmates "suffering terminal illness" are eligible under clemency laws. He granted only three applications last year, compared to 226 in Texas. His failure to free those with AIDS lacks compassion, costs taxpayers millions, and shortens prisoners' lives. One study found that due to inadequate treatment and a lack of other support services, prisoners with AIDS do not receive even "nominal" care. These prisoners are not threats to public safety. The governor has made the family a theme of his administration and has spoken eloquently about those suffering with AIDS, say Rold. Now he should show compassion for and allow at least some of the patients with AIDS to go back to their loved ones at Christmas.
