Bay Area Reporter (12/29/88) Vol. 18, No. 52, P. 20
Wockner, Rex

Abstract: The trial in Charleston of a man whose former lover accused him of hiding his HIV-positive antibody status while having unprotected sex is the first case of a law passed by the South Carolina Legislature making it illegal to knowingly pass on the virus. The law allows for maximum penalties of a $5,000 fine and 10 years in jail for anyone knowingly exposing another person through "the sale, donation, or exchange of blood products or body fluids without first informing the other person of the risk of exposure of HIV infection." Police arrested James Michael Pittman, 26, after his ex-lover, Keith Yodis, legally learned of Pittman's HIV-antibody test results from the South Carolina Department of Health and Environmental Control. Joe Hall, director of Palmetto AIDS Life Support Services (PALSS) in Charleston, is concerned becAUse the city's gays seem to be siding with Yodis. "No one realizes that this cases is a gross misdirection of our energy in fighting the spread of HIV. Another PALSS official says the law is so broad as to permit prosecution for open-mouth kissing. Some members of the city's gay community say Pittman was wrong, but note that Yodis has continued to test negative since the couple's break-up.
