The Big Easy? Legal and Managerial Perspectives on AIDS and Health Care Delivery in the 1990s

This article examines the hard medical, legal, and ethical questions that AIDS raises for health care management. It emphasizes two central issues--the duty to treat and the right of privacy--in the age of AIDS. The article focuses attention on how classic concepts are being both applied and amended in the wake of the AIDS epidemic. First, the nature of the risk of HIV transmission in the health care setting is examined. After a review of the legal and managerial aspects of these issues, the authors discuss recommendations to help health care management to deal constructively and proactively with the often complex legal and moral issues associated with AIDS.
