AIDS Center Designation/AIDS Intervention Management System

In January 1986, New York State amended Part 405 of Title 10 of the New York State Codes, Rules and Regulations to include Section 405.40 of 10 NYCRR to ensure the provision of health care services for patients with AIDS. This section, entitled "AIDS Centers," details the regulations with which hospitals must comply to be designated an AIDS center. AIDS centers are required to provide and/or arrange for all levels of care and services, including inpatient, ambulatory, home health, and personal care services; psychiatric and psychological services; housing; and legal and financial arrangements as well as appropriate hospice and residential health care services. This program will provide people with AIDS access to essential community health care resources so that they can maintain the quality of their lives in a home environment as long as possible. The AIDS centers will receive discrete inpatient and outpatient Medicaid reimbursement rates so that they can provide coordinated and comprehensive services and programs. The designated AIDS center program is not intended to relieve other hospitals of their responsibility for the care and treatment of persons with AIDS, nor is it intended to inhibit patients' freedom to seek care at other centers. The authors describe 13 requirements for general hospitals that are interested in serving as AIDS centers.
