Abstract: Governor Gary Locke of Washington State signed a law that will impose stronger penalties against people who intentionally expose others to HIV. The Governor vetoed a provision authorizing court-ordered detention of those who continue to practice dangerous sexual behavior. The bill raises the penalty for the crime of intentional HIV exposure or transmission by reclassifying it to a first-degree assault. Had Locke not vetoed the provision, the bill would have enabled public health workers to seek court orders to detain an individual for up to 90 days to enforce a program of risk-reduction counseling and education.
