Abstract: The U.S. Supreme Court refused to review an appeal by an HIV-infected soldier, Carinel Pritchard, Jr., who claimed he was wrongly imprisoned for having unprotected sex with his wife. The high court said it would not consider the soldier's argument that the Army violated his marital privacy rights. Pritchard acknowledged that safer-sex orders for HIV-positive personnel generally are a valid exercise of military authority. He argued that an exception should have been made for marital relations.
