Abstract: A New York appeals court annulled a $25,000 damage award after concluding that there was insufficient proof to support a finding that dentists Edward Anker, Jeffrey Schulman, and Jules Shteierman discriminated against a patient because of his HIV status. The dentists appealed to the States's Supreme Court Appellate Division after they were ordered by the State Division of Human Rights to pay compensatory damages. Dr. Anker referred the HIV-positive patient to a medical center because that hospital was best equipped to deal with the risk of complications from a root canal. The hospital was unable to provide immediate care and the patient called for another referral. There was no evidence that the patient returned to Dr. Anker for treatment or that Anker denied him further treatment after the referral proved unsuccessful.
