Abstract: The Texas Court of Appeals issued rulings in favor of the renowned pianist, Van Cliburn, in the breach-of-contract suit brought against him by his ex-domestic partner, Thomas E. Zaremba. Zaremba alleged that he and Cliburn had an unwritten understanding that they could share Cliburn's income in exchange for the management of the pianist's business, personal affairs, and running of the household. Zaremba claimed that Cliburn owned him millions of assets from income attributable to their partnership. The appellate court upheld a district court's ruling that Zaremba was not entitled to any community property because Texas law does not recognize marital relationships that are not heterosexual unions. The court stated that the claims amounted to a palimony suit, made illegal in Texas in 1987 unless the relationship was based on a written agreement. The appeals panel also upheld the lower court's dismissal of emotional distress claims based on Zaremba's assertion that Cliburn exposed him to HIV by engaging in unprotected sex with other men.
