Abstract: A Federal judge said that Lawyer Lynn Frank Plemmons, presiding in a custody dispute, cannot be sued for refusing to hear testimony that custody should not be limited because the mother's uncle has AIDS. Plemmons, acting as special chancery judge, was sued under the Americans with Disabilities Act (ADA) which bars discrimination on disability and association with people who have disabilities. Plemmon's decision of barring the uncle from any physical contact with the children in question was subsequently amended by the new presiding judge. The suit against Plemmons was dismissed based on the court's finding of mootness.
