Abstract: To settle a lawsuit brought by two HIV-positive job applicants, the Chicago Police Department has agreed to stop testing police recruits for HIV. According to Geoffrey Kors, American Civil Liberties Project (a branch of the American Civil Liberties Union), HIV status has no bearing on a person's ability to be an effective police officer. The suit charged violations of the Rehabilitation Act, which prohibit discrimination based on disability, and the Illinois AIDS Confidentiality Act, which requires the informed consent of a person being tested and post-test counseling. In the settlement, the city refused to admit it broke any laws, but agreed to change its employment policies regarding testing for HIV, and pay to $90,000 in legal fees and damage awards.
