Abstract: The Pennsylvania Commonwealth Court denied a teacher's assistant, who was HIV-positive, unemployment benefits because it held that the teacher had left his employment voluntarily and failed to seek alternative employment with his employers. The plaintiff claimed he felt forced to quit his classroom job because he feared infecting school children with HIV. To avoid creating a panic he decided against telling his employer and after searching for non-classroom positions in the school district and finding none, decided his only recourse was to quit. The court focused on whether the teacher could have found alternatives to quitting rather than addressing the teacher's apprehensions about HIV transmission. The court felt that because the teacher had not requested a transfer or leave of absence or other accommodation, and because he had not informed his employer of his health status, the employer could not make reasonable accommodations.
