Abstract: Memorial Hospital and Charles Hull, MD, refused to admit an AIDS patient who had had an allergic reaction to a prescription drug. A Federal district court jury awarded the patient $512,000 in compensatory and punitive damages because the hospital had violated the Rehabilitation Act of 1973 which prohibits a Federally-funded health-care provider from discrimination based on disability. Later, the hospital was found to have also violated the Americans with Disabilities Act (ADA). A Texas dental chain that had also refused to treat an HIV patient settled out of court to avoid facing a trial. This settlement was the first AIDS-related agreement with a dental service under the ADA.
