Abstract: The Equal Employment Opportunity Commission (EEOC) is suing an Indiana tavern, The Pub, on behalf of a bartender who said he was fired because he was HIV positive. The suit charged that the owner and Assistant Manager of The Pub violated the Americans with Disabilities Act (ADA) by dismissing bartender Larry Conway. The suit also alleged that they violated Conway's privacy rights under Indiana law and the ADA by disclosing his HIV status to co-workers and others. The lawyers for Conway say he was fired because of fears about HIV transmission. However, the fears are at odds with the fact that restaurant workers pose absolutely no risk to their patrons or co-workers, and that HIV can't be transmitted through food or drink.
