Abstract: U.S. District Judge Ruben Castillo ruled that a lab technician failed to furnish sufficient evidence to support his charges that he was fired because of his HIV status. According to the court, the technician (identified as R.G.H.) was unable to prove that his supervisors knew he had HIV and failed to refute major criticisms they made in his job performance evaluations. R.G.H. contracted the virus in May, 1985 while working on HIV research at Abbott Laboratories, his employer. The suit made three claims: that R.G.H. was denied a promotion in December 1992, that he was denied a pay raise in August 1992, and that Abbott lowered his performance evaluation in April 1993. There were other claims, however they were before the Americans with Disabilities Act (ADA) took effect--the ADA cannot be applied retroactively.
