Abstract: As part of a plan to control healthcare costs, Southeastern Pennsylvania Transportation Authority (SEPTA) obtained prescription utilization reports from Rite Aid pharmacies. A SEPTA employee, Doe, was noted next to a prescription for an AIDS-related drug by the chief administrative officer, who then identified Doe and other employees on an AIDS list that was circulated among SEPTA top officials. A jury held SEPTA liable for failing to properly train employees about privacy rights and awarded damages to employee Doe. Rather than face litigation, Rite Aid has agreed not to disclose the records of employees in all Pennsylvania stores.
