William Carter, M.D., of Hemispherx Biopharma on July 12, 2001, claimed that Empire Medical Resources would provide "the accrual and retention of all patients for Hemispherx clinical trials of Ampligen(R) for the treatment of HIV, as well as protocols for the treatment of Hepatitis C and the co- infection of Hepatitis C and HIV."
According to Fred Stewart, Chief Executive Officer of Empire Medical Resources, "Although we were willing to participate with Hemispherx to finally achieve a definitive study of the efficacy of Ampligen(R) for the treatment of HIV, repeated attempts, over the last nine weeks, to define and structure our alliance with Hemispherx were not successful." Mr. Stewart added, "We were confident that our network of HIV-HCV specific diagnostic and treatment centers and their proprietary data bases would be equal to the task of accelerating the investigative process." Empire had already negotiated for and acquired the exclusive global rights to proprietary EDC software, developed by DataTrial, LLC, a U.K.-based corporation, for use in clinical trials for HIV- HCV and co-infection studies.
Stewart further indicated that "upon the request of William Carter, M.D., Hemispherx Biopharma's Chairman and CEO, Empire Medical Resources engaged in an extensive screening process designed to isolate candidates that would meet Hemispherx's revised protocols. After presentation of this list of candidates and the subsequent agreement by Dr. Carter and David M. Strayer, M.D., Hemispherx's medical director that these candidates did not meet the revised protocols, Hemispherx cut off all communication and Dr. Carter did not respond to numerous telephone calls. At this point, Empire issued an invoice for services rendered, which, to this date, has not been acknowledged by Hemispherx Biopharma or Dr. Carter.
