Schering-Plough Files Patent Infringement Suit Against Amgen on INFERGEN

MADISON, N.J., Dec. 4 /PRNewswire/ -- Schering Corporation, a subsidiary of Schering-Plough Corporation (NYSE: SGP) has filed suit against Amgen Inc. of Thousand Oaks, Calif., charging that Amgen's manufacture and use of its consensus interferon product INFERGEN infringes U.S. Patent No. 4,530,901 held by Biogen Inc.

Schering Corporation is the exclusive licensee of this Biogen patent, as well as the related Biogen alpha interferon patent rights throughout the world. The Biogen alpha interferon patent rights cover, among other things, the recombinant production of alpha interferons, including Schering-Plough's INTRON(R) A (interferon alfa-2b).

The Schering suit was filed in U.S. District Court for the District of Delaware in Wilmington.

In Japan, Biogen filed a patent infringement lawsuit against Amgen Limited in 1994, charging that Amgen's efforts to develop and market consensus interferon in Japan infringe one of Biogen's Japanese alpha interferon patents.

Schering-Plough's INTRON A is approved in the United States for treating chronic hepatitis B and C, venereal warts, hairy cell leukemia, AIDS-related Kaposi's sarcoma and as adjuvant therapy for malignant melanoma. INTRON A is marketed in 68 countries worldwide for as many as 16 indications.
