Technical Chemicals & Products Receives Verdict in HIV Saliva Collector Lawsuit

Business Wire - Wednesday January 6, 1999

POMPANO BEACH, Fla.--(BUSINESS WIRE)--Jan. 6, 1999--In a civil lawsuit related to saliva collector technology for an HIV diagnostic test, a jury in Broward County (Florida) recently found that Technical Chemicals & Products, Inc. (Nasdaq:TCPI - news) did not misappropriate trade secrets. However, subject to final judgement, the jury did find against TCPI for business interference and assessed damages at approximately $325,000. The lawsuit was filed in 1995 by Americare Transtech, Inc., Americare Biologicals, Inc. and their President, Joseph P. D'Angelo, and alleged that TCPI and its Chairman, Jack Aronowitz, and several other non-related companies and individuals misappropriated trade secrets and committed business interference in relation to saliva collector technology.

Separately, the jury cleared Jack Aronowitz, individually, on the issue of business interference, but found against him for misappropriation of trade secrets and assessed damages at $500,000. In the event any individual damages are ultimately required to be paid, the Company will indemnify Jack Aronowitz.

TOTAL DAMAGES OF MORE THAN $3.1 MILLION WERE ASSESSED AGAINST THE OTHER CORPORATE AND INDIVIDUAL DEFENDANTS IN THIS CASE WHICH HAVE NO BEARING WHATSOEVER ON TCPI.

"This was a complex case and we are pleased with the jury's findings in favor of TCPI on the trade secrets issue," said Jay E. Eckhaus, TCPI's general counsel. "We will ask the Court to set aside the decision against TCPI on business interference, as well as the finding against Mr. Aronowitz as an individual. In the event they are not reversed, TCPI's attorneys will immediately begin the appeal process," Eckhaus added.
